Form I-140 is used to apply for permanent residence based on employment in the U.S.  An I-140 petition is also called an Immigrant Petition for Alien Worker. This type of visa is difficult to get, but it allows qualifying employees in the U.S. to apply for a permanent residency visa also known as a “Green Card.”

What are the Requirements for an Employment-Based Permanent Residence Petition Using Form 1-140?

You must be able to show at least one of the following:

  • You have extraordinary ability in athletics, education, business, sciences or the arts
  • You have experience as an outstanding researcher or professor
  • In the past 3 years, you have at least 1 year of employment as a multinational executive or manager for a foreign affiliate of a petitioning U.S. company
  • You have a Masters Degree and have been offered a job that is in the national interest of the U.S.
  • You have a Masters degree or a Bachelors degree with 5 years progressive experience in your field
  • You have a Bachelors degree with 2 or more year's experience
  • You have Permanent Labor Certification and evidence that you have been offered a position in the U.S. for which you qualify.


How Long is the Visa Valid?

This is a permanent residence visa and is valid indefinitely.  This visa will allow you to apply for U.S. citizenship.


Are Dependents Eligible for Permanent Residence?

Yes.  Your spouses and all children under 21 years old are entitled to permanent residence visas if you receive approval of the I-140.When approval is received you and your dependents may apply for permanent residence.  If you are in the U.S., you may adjust status to permanent residence by filing Form I-485.
